Welcome to the Autism Resource Project (“ARP,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Autism Resource Project website, ARP Navigator, community features, marketplace, library, podcasts, digital content, applications, and other products, services, resources, and features that we may make available from time to time (collectively, the “Services”).

Please read these Terms carefully. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not access or use the Services.

1. About the Autism Resource Project

The Autism Resource Project provides information, tools, resources, community connections, and other forms of support intended to assist individuals with autism, neurodivergent individuals, individuals with disabilities, families, parents, caregivers, advocates, and others seeking information and resources.

Our Services may include, among other things:

the ARP Navigator and other technology-based or artificial-intelligence-powered tools;
directories and information concerning services, providers, programs, benefits, funding, educational resources, and community organizations;
articles, research, publications, webinars, podcasts, videos, and other educational content;
community forums, support networks, groups, and other interactive features;
information regarding local resources and community representatives;
a marketplace featuring products or services that may be useful to members of the communities we serve; and
links, referrals, or introductions to third-party organizations, professionals, products, and services.

The specific Services available may change over time.

2. IMPORTANT DISCLAIMER — ARP DOES NOT PROVIDE PROFESSIONAL ADVICE

ARP is designed to provide information, education, navigation assistance, and resources. ARP is not a medical provider, healthcare provider, therapist, psychologist, attorney, financial advisor, benefits administrator, educational institution, government agency, or other licensed professional service provider.

Nothing provided through the Services should be considered or relied upon as medical, psychological, therapeutic, legal, financial, educational, benefits, insurance, or other professional advice.

Information provided by ARP should not replace consultation with qualified healthcare professionals, therapists, attorneys, educators, financial professionals, government agencies, benefits specialists, or other appropriate professionals.

You are responsible for evaluating information provided through the Services and determining whether and how it applies to your individual circumstances.

Medical Emergencies

ARP is not an emergency service.

If you believe you or another person is experiencing a medical or other emergency, contact appropriate emergency services immediately.

Do not rely on the ARP website, ARP Navigator, Community, or any other ARP Service for emergency assistance.

3. ARP Navigator and Artificial Intelligence

ARP may provide an artificial-intelligence-powered tool known as the ARP Navigator, as well as other automated or AI-assisted features.

The ARP Navigator is intended to help users identify potentially relevant information, resources, services, programs, and possible next steps based on information provided by the user.

AI-generated information may contain errors.

Artificial intelligence and automated systems are imperfect. Information generated or recommended by the ARP Navigator may be inaccurate, incomplete, outdated, unavailable, inappropriate for a particular individual, or otherwise incorrect.

You should independently verify important information before making decisions based upon information generated through the ARP Navigator.

Navigator results are not professional advice.

Results produced by the ARP Navigator do not constitute medical diagnoses, treatment recommendations, legal advice, financial advice, educational determinations, eligibility determinations, or other professional advice.

No guarantee of eligibility or services.

The ARP Navigator may identify programs, services, funding sources, benefits, organizations, providers, or other resources that appear potentially relevant to a user’s circumstances.

ARP does not guarantee that:

a user will qualify for any particular program or benefit;
a service or program remains available;
information regarding eligibility requirements is current;
a provider will accept a particular individual;
funding will be available;
insurance will cover a particular service;
a government agency will approve an application;
a particular provider or service will be appropriate for the user; or
use of a recommended resource will produce any particular result.

Eligibility and service determinations are ultimately made by the applicable provider, organization, government agency, insurer, educational institution, or other responsible third party.

4. Information You Provide

Certain Services may ask you to provide information about yourself or another individual for whom you are seeking assistance.

You agree that information you provide will be accurate to the best of your knowledge.

If you provide information concerning another individual, including a child or dependent, you represent that you have the legal authority or appropriate permission to provide that information and use the Services on that individual’s behalf.

You should not provide information that is unnecessary for your use of the Services.

Our collection and use of personal information is governed by our Privacy Policy.

5. Eligibility and Use by Minors

The Services are primarily intended for adults, including parents, caregivers, family members, advocates, and individuals seeking resources for themselves or others.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or use portions of the Services that require you to enter into a legally binding agreement unless ARP expressly permits otherwise.Parents and legal guardians are responsible for supervising the use of the Services by minors under their care.

6. Accounts

Some Services may require creation of an account.

If you create an account, you agree to:

provide accurate information;
maintain and update your account information as necessary;
maintain the confidentiality of your login credentials;
not allow unauthorized persons to use your account; and
promptly notify ARP if you believe your account has been compromised.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

ARP reserves the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to ARP, our users, or others.

7. Community Features

ARP may provide forums, groups, discussions, comments, messaging, support communities, or other interactive features (“Community Features”).

Our goal is to create a supportive, respectful, and constructive environment.

When using Community Features, you agree not to:

harass, threaten, intimidate, abuse, or discriminate against another person;
post hateful, defamatory, obscene, fraudulent, or unlawful material;
intentionally spread materially false or misleading information;
impersonate another person or organization;
disclose another person’s private or confidential information without authorization;
solicit or exploit vulnerable individuals;
advertise or solicit products or services without authorization;
upload malicious software or interfere with the operation of the Services;
collect information about other users without permission; or
use the Community Features for unlawful purposes.

ARP may, but is not obligated to, monitor, moderate, edit, remove, restrict, or disable content or accounts.

Opinions and information posted by community members belong to those users and do not necessarily represent the views, recommendations, or endorsements of ARP.

Users should exercise appropriate judgment before relying upon advice or recommendations received from other community members.

8. User Content

If you submit comments, reviews, posts, photographs, stories, recommendations, questions, or other material through the Services (“User Content”), you retain ownership of your User Content.

By submitting User Content, you grant ARP a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content as reasonably necessary to operate, provide, promote, and improve the Services, subject to our Privacy Policy and applicable law.

You represent that you have the rights necessary to submit your User Content and that your User Content does not violate the rights of another person.

9. Third-Party Providers, Professionals, Organizations, and Resources

ARP may provide information about or links to healthcare providers, therapists, educators, attorneys, advocates, government programs, nonprofit organizations, support groups, businesses, service providers, or other third parties.

Unless expressly stated otherwise, inclusion of a third party in ARP’s Services does not constitute an endorsement, certification, guarantee, or warranty by ARP.

ARP does not control and is not responsible for the acts, omissions, qualifications, availability, pricing, policies, services, advice, or performance of third parties.

Users are responsible for independently evaluating providers and determining whether a provider, service, product, program, or organization is appropriate for their needs.

Any relationship or transaction between a user and a third party is between those parties.

10. Marketplace

ARP may operate or provide access to a marketplace featuring products or services intended to support individuals with autism, neurodivergence, disabilities, families, and caregivers.

Marketplace products may be sold directly by ARP or by third-party sellers, manufacturers, retailers, or service providers.

Where a third party sells or fulfills a product, additional terms established by that third party may apply.

The inclusion or recommendation of a product in the Marketplace does not constitute medical advice or a representation that the product will be suitable, safe, or effective for every individual.

Users should review product information, warnings, instructions, age recommendations, and other applicable information before use and consult an appropriate professional where necessary.

Additional purchase, shipping, return, refund, subscription, or marketplace terms may apply to transactions and will be presented where appropriate.

11. Library, Research, and Educational Content

ARP may curate articles, studies, journals, webinars, publications, research, educational materials, and other informational resources.

ARP endeavors to provide useful and credible information, but research, clinical guidance, government programs, laws, regulations, eligibility requirements, and accepted practices change over time.

Accordingly, ARP does not warrant that every resource is complete, current, or applicable to every individual.

Users should consult original sources and qualified professionals before making significant medical, legal, financial, educational, or other decisions.

12. Podcasts, Videos, Interviews, and Guest Content

ARP may publish podcasts, interviews, videos, articles, webinars, and other content featuring guests, experts, professionals, advocates, community members, and other third parties.

Views expressed by guests are their own and do not necessarily represent the views of ARP.

The appearance of a guest or expert does not constitute an endorsement of that individual’s services, products, organization, opinions, or recommendations.

13. Donations

ARP may accept charitable contributions or other forms of financial support.

Unless expressly stated otherwise, donations are voluntary and non-refundable to the extent permitted by law.

The availability of a tax deduction depends upon ARP’s applicable tax status, the nature of the contribution, and the donor’s individual circumstances. ARP does not provide tax advice.

Donors should consult their own tax advisor regarding the deductibility of contributions.

14. Third-Party Websites and Services

The Services may contain links to websites, applications, products, services, or resources operated by third parties.

ARP does not control third-party services and is not responsible for their content, availability, security, privacy practices, accuracy, or operation.

Your use of third-party services is subject to the terms and policies of those third parties.

15. Intellectual Property

Unless otherwise indicated, the Services and their content—including text, graphics, logos, designs, software, databases, audio, video, podcasts, images, trademarks, and other materials—are owned by or licensed to ARP and are protected by applicable intellectual property laws.

ARP grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for lawful personal and informational purposes.

Except as permitted by law or with ARP’s written permission, you may not:

reproduce or commercially distribute ARP content;
modify or create derivative works from ARP content;
remove copyright, trademark, or proprietary notices;
scrape, harvest, or systematically extract information from the Services;
reverse engineer software or technology used by the Services; or
use ARP’s name, trademarks, branding, or content in a manner suggesting endorsement or affiliation without authorization.

16. Acceptable Use

You agree not to use the Services:

for any unlawful, fraudulent, or abusive purpose;
to violate another person’s rights;
to gain unauthorized access to systems, accounts, or information;
to introduce viruses, malicious code, or harmful technology;
to interfere with the security or operation of the Services;
to circumvent access or security restrictions;
to scrape or collect data through automated means without permission;
to use information obtained through ARP to harass, discriminate against, exploit, or harm another person; or
in any manner inconsistent with these Terms.

17. Privacy

Your privacy is important to us.

Our collection, use, disclosure, retention, and protection of personal information are described in the ARP Privacy Policy, which is incorporated into these Terms by reference.

Because users may provide information relating to health, disability, education, family circumstances, location, or services being sought, we encourage users to carefully review the Privacy Policy before using personalized features of the Services.

18. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

ARP DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, ACCURATE, COMPLETE, OR SUITABLE FOR EVERY USER.

ARP DOES NOT WARRANT OR GUARANTEE THE ACCURACY OF AI-GENERATED RESULTS, THIRD-PARTY INFORMATION, RESOURCE AVAILABILITY, PROVIDER INFORMATION, BENEFITS INFORMATION, RESEARCH MATERIALS, OR USER-GENERATED CONTENT.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARP AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF THE SERVICES.

This includes, without limitation, damages resulting from reliance upon information provided through the ARP Navigator, Community, Library, Marketplace, third-party resources, or other Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ARP and its directors, officers, employees, volunteers, contractors, affiliates, and agents from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the Services, your violation of these Terms, your User Content, or your violation of another person’s rights.

21. Changes to the Services

ARP is continually developing and improving its Services.

We may add, modify, suspend, discontinue, or restrict any portion of the Services at any time, subject to applicable law.

We do not guarantee that any particular feature, resource, provider, program, product, or Service will remain available.

22. Suspension and Termination

ARP may suspend or terminate access to all or part of the Services if we reasonably believe that a user:

has violated these Terms;
presents a security or safety risk;
has engaged in fraudulent, abusive, or unlawful conduct; or
has used the Services in a manner that could harm ARP, its users, or third parties.

Users may stop using the Services at any time.

23. Copyright Complaints

ARP respects intellectual property rights.

If you believe material available through the Services infringes your copyright or other intellectual property rights, please contact us at the contact information below with sufficient information for us to investigate the matter.

ARP may adopt additional procedures for handling copyright notices as required by applicable law.

24. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or the Services will be resolved in the courts located in [COUNTY, STATE], unless the parties agree otherwise or applicable law provides a different requirement.

We may update these Terms periodically to reflect changes to our Services, technology, practices, or legal obligations.

When we make material changes, we will update the “Last Updated” date and provide additional notice where required by law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented in connection with particular Services, constitute the agreement between you and ARP regarding your use of the Services.
